1Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the Trustlytics Consulting website and any business automation, digital marketing, or web design services ("Services") provided by Trustlytics Consulting ("Trustlytics," "we," "us," or "our").

By accessing our website, submitting an inquiry, signing a proposal, or otherwise engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use our website or Services.

2Our Services

Trustlytics provides professional services including, but not limited to:

  • Business Automation — workflow automation, CRM setup, process integration, and related consulting
  • Digital Marketing — search engine optimization, paid advertising, social media management, and content strategy
  • Web Design — website design, development, hosting coordination, and maintenance

The specific scope, deliverables, timeline, and fees for any engagement will be set out in a separate proposal, statement of work, or service agreement, which forms part of these Terms.

3Client Accounts & Information

To deliver our Services, we may require access to certain client accounts, platforms, or credentials (for example, advertising accounts, website hosting, or CRM systems). You agree to:

  • Provide accurate, current, and complete information
  • Grant necessary access in a timely manner so we can perform the agreed Services
  • Keep your own account credentials secure and notify us promptly of any unauthorized access

We are not responsible for delays or issues caused by inaccurate information or delayed access provided by the client.

4Payment & Billing

  • Fees for Services are outlined in your proposal, invoice, or service agreement
  • Invoices are due within the timeframe specified on the invoice, unless otherwise agreed in writing
  • Late payments may result in suspension of ongoing Services, including active advertising campaigns, automation workflows, or website work
  • Any third-party costs (e.g., ad spend, software licenses, domain/hosting fees) are separate from our service fees unless stated otherwise
All fees are quoted exclusive of applicable taxes unless stated otherwise in your agreement.

5Client Responsibilities

As a client, you agree to:

  • Provide feedback, approvals, and content (copy, images, brand assets) within agreed timelines
  • Ensure that any materials you provide do not infringe on third-party rights or violate applicable law
  • Use our deliverables (automation systems, marketing campaigns, websites) in compliance with the platforms' own terms of service (e.g., Google, Meta, hosting providers)
  • Cooperate reasonably to allow us to deliver the Services as agreed

6Intellectual Property

Our pre-existing IP

Trustlytics retains ownership of all proprietary tools, frameworks, templates, automation scripts, and methodologies developed prior to or independently of a client engagement.

Client deliverables

Upon full payment, ownership of final client-specific deliverables (such as a completed website, designed assets, or campaign creatives) transfers to the client, unless otherwise specified in your service agreement. Trustlytics may retain the right to showcase completed work in its portfolio, unless you request confidentiality in writing.

Third-party materials

Some deliverables may include third-party licensed materials (fonts, stock imagery, plugins, software), which remain subject to their own respective license terms.

7Third-Party Tools & Platforms

Our Services may rely on third-party platforms such as advertising networks, hosting providers, CRM systems, and automation software. Trustlytics is not responsible for outages, policy changes, price changes, or account restrictions imposed by these third parties, though we will make reasonable efforts to keep you informed and adapt strategies where possible.

8Cancellation & Refunds

9Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis. While we apply industry best practices, Trustlytics does not guarantee specific results, including but not limited to search engine rankings, advertising conversion rates, lead volumes, revenue outcomes, or uninterrupted website uptime, as these depend on factors outside our control.

10Limitation of Liability

To the fullest extent permitted by law, Trustlytics Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our Services or website. Our total liability for any claim shall not exceed the amount paid by you to Trustlytics for the Services giving rise to the claim in the preceding three (3) months.

11Indemnification

You agree to indemnify and hold harmless Trustlytics Consulting, its employees, and contractors from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of our Services, or infringement of any third-party rights through content or materials you provide to us.

12Termination

We reserve the right to suspend or terminate Services if a client breaches these Terms, fails to make payment, or requests work that is unlawful or unethical. Upon termination, any outstanding fees for work completed become immediately due.

Termination does not relieve either party of obligations that accrued prior to the termination date.

13Governing Law

These Terms are governed by and construed in accordance with the laws applicable in our jurisdiction of operation, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts in that location, unless otherwise agreed in a signed service agreement.

14Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services or legal requirements. The "Last updated" date at the top of this page indicates when changes were made. Continued use of our website or Services after updates constitutes acceptance of the revised Terms.
